What To Do After A Car Accident In Las Vegas

Right after a crash, it can be hard to know what to do first. Start with these four steps. They can help keep you safe and protect your claim later.

  • Get somewhere safe and call 911. If anyone is injured, stay at the scene and report the crash. Nevada law requires drivers to stop after an accident involving injury. Ask for a copy of the police report once it’s available.
  • Take pictures before you leave. Get the damage from different angles, along with the road, signs, traffic lights, skid marks, and anything else that may help show how the crash happened. Get the other driver’s insurance and contact information too. No officer came to the scene? You may need to file an SR-1 with the DMV within 10 days.
  • Don’t ignore symptoms that show up later. A sore neck or back, headaches, dizziness, or trouble concentrating may not start at the scene. See a doctor and keep your records and bills. They can matter if you end up making an injury claim. Get checked early.
  • Talk to a lawyer before you talk to the insurer. You do not have to handle the insurance conversation on your own. Nevada law also prohibits an insurer from telling you that you should not hire a lawyer.

Nevada generally gives you two years to file a car accident lawsuit, but useful evidence can disappear much sooner. We can help with filing your car accident claim.

Compensation You Can Recover After A Crash

Emergency care, surgery, rehabilitation, medication, and treatment you may need in the future.

Wages you missed while recovering, along with future earnings if your injury affects your ability to work.

There is no set dollar amount for these damages. Your injury, recovery, and impact on your daily life all matter.

The cost to repair or replace your vehicle, rental expenses, and diminished value.

These are reserved for certain serious cases, including drunk driving and extreme reckless conduct.

Nevada follows a modified comparative negligence rule. If you are 20% at fault for a $100,000 claim, for example, you could recover $80,000. If your share of the fault is more than 50%, you cannot recover damages. For a better idea of what a Las Vegas car accident claim is worth, the facts and losses have to be considered.

Questions About Your Las Vegas Car Accident Claim

  • Should I talk to the insurance company before I call a lawyer?

You don’t have to give the insurance company a recorded statement right away. An adjuster may call soon after the crash and ask what happened. It’s worth speaking with a lawyer before you make that statement. Nevada law also says an insurer cannot tell you not to hire one.

  • How long do I have to file a car accident claim in Nevada?

  • What if I was partly at fault for the crash?

  • What if the driver who hit me had no insurance?

  • How much is my Las Vegas car accident case worth?
