A crash can leave you shaken, even when the damage looks minor at first. The steps you take early can help protect your health, your claim, and the records your lawyer may need later. Here’s what to do:
Insurance adjusters may be polite, but they are not there to protect your claim. At Gina Corena & Associates, we can speak with the insurance company on your behalf, review what happened, and explain your options during a free case review.
Nevada follows a modified comparative negligence rule. This means you can still recover compensation if you were partly at fault, as long as you are not more than 50% responsible for the crash.
For example, if another driver ran a red light but you were found 20% at fault for speeding, your compensation could be reduced by 20%. So if the total damages were $100,000, the recovery would be reduced to $80,000.
Nevada uses an at-fault system for car accident claims. This means the driver who caused the crash is generally responsible for the resulting losses, including medical bills, vehicle damage, lost income, and other case-related damages.
Because fault is central to the claim, evidence matters. Police reports, photos, witness statements, medical records, vehicle damage, and crash reconstruction can all help show how the accident happened.
Nevada generally gives injured people two years from the date of the crash to file a personal injury lawsuit. If you miss that deadline, the court may dismiss your case.
Two years may sound like plenty of time, but medical treatment, insurance delays, missing evidence, and witness availability can all affect your claim, so it is better to act early.
Nevada has separate reporting rules after certain crashes. If law enforcement does not investigate the crash at the scene, you may need to file an SR-1 report with the Nevada DMV within 10 days when the accident involves injury, death, or $750 or more in vehicle or property damage.
This report is different from a personal injury lawsuit. It helps create an official record of the accident, but it does not replace the deadline for filing a legal claim.
Nevada requires drivers to carry minimum liability insurance. The current minimums are $25,000 for bodily injury or death of one person, $50,000 for bodily injury or death of two or more people in one accident, and $20,000 for property damage.
In practice, those minimums may not cover serious injuries from crashes. Medical bills, lost income, long-term care, and vehicle damage can add up quickly.
Some crashes involve drivers with no insurance or insufficient insurance to cover the harm they caused. In those situations, uninsured or underinsured motorist coverage, often called UM/UIM coverage, may help through your own policy.
